A Bold Decision That Stirs Debate: President Prabowo Restores the Reputation of Former ASDP Executives

In a headline that has sparked both support and skepticism, President Prabowo Subianto has granted official rehabilitation to three individuals previously convicted in the corruption case tied to PT ASDP Indonesia Ferry — the nation’s state-owned ferry company. Among those cleared is the company’s former CEO, Ira Puspadewi, whose name has long been at the center of this high-profile corporate scandal.

And this is where it gets controversial: many see this move as a sign of justice finally being served, while others question whether the timing and motives behind it might signal something deeper.

House of Representatives (DPR) Deputy Speaker Sufmi Dasco Ahmad confirmed on Tuesday that the decree also includes former ASDP executives Muhammad Yusuf Hadi and Harry Muhammad Adhi Tjaksono. He revealed that after extensive talks between lawmakers and government officials, President Prabowo personally signed the rehabilitation order restoring their civil and professional standing.

Under Indonesian law, rehabilitation refers to the reinstatement of a person’s legal rights, good name, and dignity after they have been unjustly treated or subject to flawed judicial proceedings. In simple terms, it’s a way of formally acknowledging that someone’s reputation deserves to be repaired.

Ahmad noted that the president has been deeply concerned about the case since it first drew public attention in mid-2024. The parliament reportedly received multiple appeals and insights from citizens questioning the fairness of the legal process. In response, the DPR’s Commission III — which handles laws and justice — conducted a thorough study on the matter. Their findings were later submitted to the executive branch for presidential review.

The saga traces back to PT ASDP Indonesia Ferry’s acquisition of PT Jembatan Nusantara (JN) between 2019 and 2022 — a move intended to strengthen the state enterprise’s logistics network. However, this corporate takeover soon drew the attention of the Corruption Eradication Commission (KPK), which alleged that irregularities in the valuation and approval steps had led to a staggering state loss of Rp1.25 trillion (approximately US$75 million).

Despite the KPK’s claims that the transaction unfairly benefited JN, further investigations revealed that Puspadewi herself never received any personal financial gain. Even so, the Corruption Court still found her guilty, sentencing her to four and a half years in prison — a verdict many legal analysts described as questionable.

But here’s the part most people miss: during the trial, Presiding Justice Sunoto delivered a rare dissenting opinion. He argued that Puspadewi’s decisions fell squarely within the accepted boundaries of the business judgment rule — meaning her actions were professional decisions made in good faith, not attempts at corruption. According to Sunoto, she should have been acquitted entirely.

Supporters of the president’s recent move see the rehabilitation as a long-overdue correction of a flawed process. Critics, meanwhile, worry it could set a precedent for revisiting other sensitive graft cases — blurring the line between justice and political discretion.
